EVENT LIABILITY WAIVER & ASSUMPTION OF RISK

PLEASE READ CAREFULLY — THIS IS A RELEASE OF LIABILITY

By signing and submitting this form, I voluntarily choose to participate in activities provided by Aspen Sauna Company, LLC (“ASC”), including use of the mobile sauna, cold plunge, and related wellness or recreational activities (collectively, the “Activities”).

ASSUMPTION OF RISK

I understand that participation in the Activities involves inherent risks, including but not limited to: heat exposure, dehydration, dizziness, fainting, burns from hot surfaces, heat exhaustion or heat stroke, cold shock, hyperventilation, numbness, loss of coordination, slips, trips or falls (including on wet or icy surfaces), contact with fixed or hard surfaces in or around the sauna or plunge area, loss of consciousness in or near water, cardiac or respiratory complications, aggravation of pre-existing medical conditions, serious injury, or death.

I understand the sauna operates at elevated temperatures and uses a propane-powered heating system with hot surfaces, and that the cold plunge use involves rapid temperature change.

I voluntarily and knowingly assume all risks, whether known or unknown, associated with my participation in the Activities.

PARTICIPANT RESPONSIBILITY

I represent that I am physically and mentally able to participate and am not under the influence of alcohol, drugs, or medications that impair judgment or physical ability. ASC does not provide medical advice or supervision. I agree to take responsibility for my own well-being, including staying properly hydrated, following all posted rules and verbal instructions, and exiting immediately if I feel unwell.

I acknowledge that certain conditions may be outside ASC’s control, including weather, ground conditions, and the actions of other participants or third parties.

RELEASE OF LIABILITY

By choosing to participate in the Activities, I hereby release and hold harmless Aspen Sauna Company, LLC and its owners, members, employees, and volunteers from any claims, injuries, losses, or damages arising out of or related to my participation, including those arising from the ordinary negligence of ASC, to the fullest extent permitted by Colorado law.

I understand that by agreeing to this waiver, I am giving up my right to sue ASC for injuries or damages related to participation in the Activities.

PERSONAL PROPERTY

ASC is not responsible for loss, theft, or damage to personal property brought to or used during the Activities.

PHOTO & MEDIA RELEASE

I grant Aspen Sauna Company, LLC permission to photograph, record, and use my likeness, image, or voice captured during the Activities for marketing, promotional, and documentation purposes, across all of ASC’s platforms, channels, and media formats, without compensation, unless I notify ASC in writing prior to or at the time of participation.

GOVERNING LAW

This Agreement is governed by the laws of the State of Colorado. If any portion is found unenforceable, the remaining portions shall remain in effect.
